Terms of Service

These terms govern the assisted ProofLantern pilot and any related software access.

1. Provider and acceptance

The service is provided by Dmytro Galaktionov, an independent software seller based in Ukraine (“Provider,” “we,” or “us”). By paying for, accessing, or using the pilot, the customer agrees to these Terms and the linked Privacy and Refund Policies.

2. Pilot service

The assisted pilot may include:

  • configuration of an honest post-service review request;
  • a direct link or QR code to the customer’s Google review form;
  • an email workflow and optional compliant SMS when enabled;
  • a manually installed website review widget;
  • campaign activity reporting and onboarding support.

Features may be delivered manually during the validation period. Automatic Google review synchronization is not included unless separately confirmed in writing after provider approval.

3. Customer responsibilities

The customer agrees to:

  • provide accurate business and website information;
  • use only customer contact data it is legally permitted to use for the requested campaign;
  • honor unsubscribe and STOP requests;
  • obtain any website or account permissions needed for installation;
  • ensure any review content supplied for display may lawfully be reused.

4. Review integrity and acceptable use

The service must not be used for review gating, rating pre-screening, fake reviews, incentives, purchased contact lists, harassment, misleading claims, or attempts to suppress legitimate negative feedback. The same honest Google review path must be available to every eligible recipient. We may pause or terminate use that creates legal, platform-policy, security, or reputation risk.

5. Fees, renewal, and cancellation

The initial offer is a USD $299 assisted setup and USD $49 per month per location after the 14-day pilot, unless a written order states otherwise. A USD $100 deposit may be used to reserve the pilot and is credited toward setup. Recurring service renews monthly until canceled. The customer may cancel future renewal at any time by emailing galionix2@gmail.com.

6. Third-party services

The pilot may rely on Google, website platforms, email or SMS providers, hosting services, and payment providers. Their availability and policies are outside our control. The customer remains responsible for its own third-party accounts and permissions.

7. No performance guarantee

We do not guarantee a rating, ranking, review count, delivery rate, revenue result, or that any individual request caused a Google review. Reporting may describe new reviews observed during a campaign period, not person-level attribution.

8. Intellectual property

We retain ownership of the service, software, templates, and general implementation methods. The customer retains ownership of its brand, customer data, and content. The customer grants us a limited license to use those materials only to deliver and demonstrate its configured pilot.

9. Liability and termination

To the maximum extent allowed by law, the service is provided on an “as available” basis. Neither party is liable for indirect, incidental, or consequential loss. Our total liability for a claim is limited to fees paid by the customer during the three months before the event giving rise to the claim. Either party may terminate the pilot for material breach; we may suspend immediately for unlawful, deceptive, or unsafe use.

10. Governing law and contact

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Before filing a claim, the parties agree to attempt a good-faith resolution by email. Contact galionix2@gmail.com.
